Compulsory Acquisition: 31 August 2020
Last month the community consultation process concerning the Planning Scheme Amendment for the Barwon Heads Road Duplication Project came to a close.
Major Roads Projects Victoria (MRPV) will now be assessing feedback from the community and stakeholders before submitting its final proposed Planning Scheme Amendment to the Minister for Planning for approval.
The proposed Planning Scheme Amendment seeks to duplicate four kilometres of Barwon Heads Road from Settlement Road to Reserve Road. As part of the Planning Scheme Amendment process MRPV are seeking approval to apply a further Public Acquisition Overlay to additional land that will be required to construct the Project (this is land that is additional to land that is already the subject of Public Acquisition Overlays).
Importantly for landowners, the duplication will require the compulsory acquisition of land adjacent to Barwon Heads Road to complete the Project, once all of the land required is the subject of a Public Acquisition Overlay.
We understand that MRPV has already engaged with landowners who will be impacted by the Project's compulsory acquisition process, however these acquisitions will soon become a reality once the Planning Scheme Amendment is approved and the additional Public Acquisition Overlays are applied.
If you would like a greater understanding of the compulsory acquisition process in relation to the Project or to discuss whether a Public Acquisition Overlay is likely to be placed over your property, please feel free to contact us to arrange a mutually convenient time to discuss your queries.
