Update on Healesville- Koo Wee Rup Road Upgrade Project

Compulsory Acquisition: 17 January 2020

On 24 December 2019, the Minister for Planning approved Amendment C255card into the Cardinia Planning Scheme which, amongst other things, inserted the Healesville-Koo Wee Rup Road Upgrade Project Incorporated Document into the Planning Scheme. The purpose of the Incorporated Document is to allow the road widening for Healesville-Koo Wee Rup Road between the Princes Freeway and Manks Road.

Now this document has been published and incorporated into the Planning Scheme, we believe the Authority will shortly begin serving Notices of Intention to Acquire (the Notice) to those affected by the Healesville-Koo Wee Rup Road Project.

Aitken Partners compulsory acquisition team has more than two decades of combined experience in representing landowners, tenants and business owners in compulsory acquisition claims in most of Victoria's major infrastructure projects.

Aitken Partners compulsory acquisition team is passionate about landowners' rights and act exclusively for landowners, tenants and businesses. We understand that sometimes a compulsory acquisition may involve more than just the taking of one's land and can be an emotional process. Our team is empathetic, supportive, approachable and most importantly, reasonable.

In addition, Aitken Partners compulsory acquisition team has a great deal of experience with and understands the many complexities associated with the compulsory acquisition of commercial land. For example, Aitken Partners recently acted in the Supreme Court for successful claimants in the matter of Provans Timber Pty Ltd in relation to a business being conducted on a property owned by related entities. Both entities were found to have an interest in the acquired land and therefore both entities were entitled to separate claims for compensation as a result of the acquisition.

For those impacted by the Healesville-Koo Wee Rup Road Project, it is imperative they engage lawyers experienced in compulsory acquisition to assist them in obtaining appropriate compensation. These processes are covered by unique legislative regimes which do not follow standard property and conveyancing law practices.

Given the acquisition process is imminent, if you are affected by the Healesville-Koo Wee Rup Road Project, please contact Natalie O'Flynn on 03 8600 6046 to arrange a time to speak with our compulsory acquisition team regarding the acquisition process and your potential rights to compensation.
